Continental CrimpCloud Privacy Policy


Welcome to Continental CrimpCloud  application (“CrimpCloud” or “Service”). This Privacy Policy describes how ContiTech USA, Inc. (“ContiTech”, “We”, “Us”, or “Our”) protects any personal information (i.e., information that can be used to identify You) that ContiTech collects about You when You set-up and use the Service.  It also outlines how ContiTech uses the information it collects about You.  By using the Service, You agree to the terms of this Policy, and consent to ContiTech’s use of the information collected through the Service.

Please read this Privacy Policy carefully. BY CREATING AN ACCOUNT, USING THE SERVICE, OR SUBMITTING ANY INFORMATION (INCLUDING PERSONAL INFORMATION AND NON-PUBLIC INFORMATION), YOU AGREE TO BE BOUND TO THE TERMS OF THIS PRIVACY POLICY AND TERMS OF USE.  IF YOU DO NOT ACCEPT THE TERMS OF THIS PRIVACY POLICY, DO NOT ACCESS OR USE THE SERVICE. 

 

Whenever You interact with Us on behalf of another individual or entity, such as by providing or accessing Personal Information about another individual, You represent that Your interactions and exchanges comply with applicable data protection laws. You shall have sole responsibility for any violation of privacy laws as a result of a failure to inform the other individual about how their Personal Information will be processed or Your failure to obtain any necessary consent from such individual.

Changes: ContiTech may modify this Policy from time to time without further notice.  Changes to the Privacy Policy become effective immediately upon notice to You. Notice may be given by posting the revised Privacy Policy on the www.crimpcloud.com website or by other means.  Your use of the Service after notice constitutes Your acceptance of the revised terms.  If any of the changes are unacceptable to You, please immediately cease interacting with Us. When required by applicable law, We will notify You of any changes to this Privacy Policy by posting an update on the www.crimpcloud.com website, or by otherwise notifying You in accordance with applicable law. When required by applicable law, We will seek Your consent before making material changes to the way We handle Personal Information previously collected from You. If You do not provide such consent, Personal Information will continue to be used in a manner that is consistent with the version of the Privacy Policy under which it was collected.

Sources of Personal Information

 

We collect information about You and how You interact with Us in several ways, including:

 

a.       Information You provide to Us directly.  We collect the information You provide to Us directly.

b.       Information automatically collected or inferred from Your interaction with us.  We automatically collect technical information about Your interactions with Us (such as IP address and browsing preferences).

c.       Information from third parties.  We may receive information about You and Your interactions with Us from third parties, such as the Subscriber, Your employer or coworkers, third party service and content providers, credit reporting agencies, companies that provide or sell lists of potential purchasers, and others interacting with us.

We may combine information that We receive from the various sources described in this Privacy Policy, including third party sources and public sources, and use or disclose it for the purposes identified below.

Personal Information Collected By ContiTech

ContiTech may collect personal information that can be used to identify You individually, such as Your name, address, and e-mail address, when You register as a user of the Service. 

 

As used in this Privacy Policy, “Personal Information” refers to any information relating to an identified or identifiable natural person or household, and includes, but is not limited to, the categories and types of “personal information” or “personal data” set forth in applicable data protection laws and regulations.

ContiTech does not collect Personal Information unless You voluntarily submit it in connection with Your use of CrimpCloud, send inquiries to ContiTech, or participate in certain activities available via CrimpCloud.  We collect Personal Information when You choose to use certain features of CrimpCloud, including when You register for or create an account.

 

The types of Personal Information that We may have collected about You during Your registration and use of the Service during the preceding 12 months are:

 

a.       Identifiers, such as Your name, alias, postal address, country of residence, unique personal identifier, online identifier, internet protocol address, email address, account name, phone number, social media identifiers (e.g., Twitter handle, Instagram name, etc.) social security number, driver’s license number, passport number, or other similar identifiers.

1.       Special Note About IP Addresses. An IP address is a number that is assigned automatically to Your computer when You connect to the world wide web.  Your computer is identified by its IP address.  We collect your IP address for system administration and to audit the use of the Service, but we do not share your IP address with 3rd Parties. 

b.       Internet or other electronic network activity information, such as Your browsing history, search history, and information regarding Your interactions with Us (including interacting with Us through CrimpCloud, online, and through advertisements).

c.       Inferences drawn from any of the information We collect to create a profile about You reflecting Your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

Note that We generally try to match the information that We collect from You to the information We require in order to provide You the information, products or services You request, and the above list is broad to simply capture the types of information required for many possible different interactions between us.  Not all of the above information is captured for each interaction between us.  Our core business is providing products and services and information about those products and services, as well as information that can help Us improve those products and services, as opposed to collecting information about You and trying to monetize that information in a manner not related to the products and services We provide.  Sometimes We do need to share information We collect with third party service provides in order to provide You the information, products or services You request (see below for more details about sharing of information).  Privacy expectations and regulations are changing, and We expect Our use and handling of Your information will change over time to meet those changes and expectations. 

How We Use Your Personal Information

 

We may use each category of Your information described above in the following ways:

 

a.       To enable interactions between You and us, such as to facilitate online purchases of Our products; process shipping and returns; register and administer Your account, provide You with and support Your interactions with us; diagnose, repair and track service and quality issues; facilitate an order, download, return, or exchange; provide requested product information; communicate with You about Your account or Our data practices; install and configure changes and updates to programs and technologies related to interactions with us; authenticate those who interact with us; or to respond to Your requests, complaints, and inquiries.

b.       For Our own internal business purposes, such as to evaluate or audit the usage and performance of programs and technologies related to interactions with us; evaluate and improve the quality of the Service and Your interactions with Us and programs and technologies related to interactions with us; design new services; process and catalog Your responses to surveys or questionnaires (e.g., customer satisfaction reviews); perform internal research for technological development and demonstration; conduct data analysis and testing; maintain proper business records and other relevant records.

c.       For legal, safety or security reasons, such as to comply with legal requirements; protect Our safety, Our property or rights of those who interact with us, or others; and detect, prevent, and respond to security incidents or other malicious, deceptive, fraudulent, or illegal activity.

d.       In a de-identified, anonymized or aggregated format.  When converted to a de-identified, anonymized, or aggregated format, data no longer constitutes Personal Information and We may use this information for any purpose.

e.       For any other purposes for which You provide consent.

f.        For marketing purposes.  We may use Your Personal Information to market Our products or services or those of third parties, such as Our business partners. We may use Your Personal Information when You participate in marketing surveys, questionnaires, promotions, events or contests.  We may audit aspects of Our ad impressions. We may use Your Personal Information for short-term transient use, including for contextual ad customization. We may use Your Personal Information to enhance Our content and to potentially send You commercial emails, and we will obtain your consent or offer you an opportunity to opt-out as required by applicable law. 

g.       For Our legitimate interests or those of a third party. A legitimate interest is when We have a business or commercial reason to use Your information, so long as this is not overridden by Your own rights and interests

With Whom We Share Your Personal Information

ContiTech will not use, disclose, or sell Your Personal information to any third parties for any purposes other than those necessary to deliver the Service and as described herein. Additionally, We will not sell or transfer to unaffiliated third parties any Personal Information that You submit or any non-identifying information collected without Your consent.  We may share Your Personal Information with the categories of recipients described below:

 

a.       Affiliates and subsidiaries:  We may share Your Personal Information within the Our group of companies, which includes parents, corporate affiliates, subsidiaries, business units and other companies that share common ownership for the purposes described above.

b.       Third party service providers: We may share Your Personal Information with third party service providers working on Our behalf in order to facilitate Our interactions with You or request or support Our relationship with you, such as hosting service providers, IT providers, operating systems and platforms, internet service providers, analytics companies, and marketing providers (e.g., We may share Your email address with Our outbound email marketing provider).  We may contract with other companies to provide certain services, including shipping, identity verification, email distribution, market research, promotions management and payment processing. We provide these companies with only the information they need to perform their services and work with them to ensure that Your privacy is respected and protected.

c.       Business Partners: We may also provide Your Personal Information or provide access to Your Personal Information to Our business partners, including for third party marketing or as a sale. If legally required, We will seek Your consent before engaging in such sharing.

d.       For legal, security and safety purposes:  We may share Your Personal Information with third parties such as law enforcement or other government agencies to comply with law or legal requirements; to enforce or apply Our Terms of Use and other agreements; and to protect Our rights and Our property or safety of Our users or third parties.

e.       In connection with a transaction:  If We sell some or all of Our assets, merge or are acquired by another entity, including through a sale or in connection with a bankruptcy, We will share Your Personal Information with that entity.

f.        Your employer or coworkers:  If You interact with Us in connection with Your employment, Your employer, coworkers, or other individuals designated by Your employer may view any Personal Information that We collect in connection with Your use of or interaction with us.

We may also de-identity, anonymize, or aggregate Personal Information to share with third parties for any purpose.

Your Rights

Please note that under applicable data protection laws and regulations you may have the following rights in connection with ContiTech’s processing and use of your Personal Information:

 

·         Right of Information/Notice. You have the right to be informed about the types of Personal Information that we collect and how we use such Personal Information. ContiTech provides this Policy, detailing how Personal Information is processed, including the third parties with which ContiTech has shared your Personal Information.  ContiTech will provided updated notice and information any time the types of Personal Information processed and/or ContiTech’s use and sharing of your Personal Information materially change.

·         Right to Revoke Consent (where applicable). Where processing of your Personal Information is based upon your consent, you may withdraw consent at any time, and the ContiTech will stop processing and delete your Personal Information, subject to the ContiTech’s right to retain the data as allowed for lawful purposes, including to comply with its legal obligations and to use it exclusively on an anonymized basis. Consent must be withdrawn in writing to privacy@continental.com.

·         Right of Access. You may obtain from the ContiTech confirmation regarding whether Personal Information is being processed and, if it is, access to the Personal Information and additional information about the processing of such Personal Information.

·         Right to Correction/Rectification. You may have inaccurate Personal Information corrected and have incomplete Personal Information made complete.

·         Right to Deletion. You may have Personal Information deleted in certain circumstances.

·         Right to Restrict Processing. You may have additional processing of Personal Information restricted and/or temporarily blocked while the sufficiency, necessity, accuracy, or legality of processing of the Personal Information is contested.

·         Right to Data Portability. You may be able to receive Personal Information for the purpose of providing that Personal Information to another controller, either through you as our business customer or directly by ContiTech.

·         Right to Object. You may object, at any time and on grounds relating to their particular situation, that processing of Personal Information is unnecessary or excessive.

·         Right to Complain to the Relevant Supervisory Authority. If you have a complaint about our privacy practices, you have the right to submit a complaint to a relevant supervisory authority.

You may exercise your rights by using the contact information set forth in Section 10 below.  You may correct or update any of the Personal Information You provided to Us when You registered for an account on the Service by editing your Registered User profile.

We may request additional information from you as necessary to allow you to exercise your rights, and we may deny your request where we have a legitimate basis to do so.

Changing or Removing Your Personal Information

You may request deletion of Your personal information, but please note that We may be required to keep this information and not delete it (or to keep this information for a certain time, in which case We will comply with Your deletion request only after We have fulfilled such requirements). When We delete any information, it will be deleted from the active database, but may remain in our archives.

ContiTech will retain any Personal Information that You submit in connection with Your account unless ContiTech deems such Personal Information to violate this Privacy Policy, the Terms, or until such time as You decide to remove such Personal Information. You understand that deleted Personal Information may persist for a reasonable period of time in backup copies but will not be available to others.

If You wish to review, change, or remove any Personal Information that You have provided in connection with the Service, or if You wish to delete Your account with us, please email Us at crimpcloud@continental.com .

Cookies, Analytics, and Other Automatic Data Collection Tools

ContiTech automatically collects certain non-identifying information about You (such as Your movement about CrimpCloud, the pages You visit most frequently, the type of browser or computer operating system You use, or the domain name of the website from which You link). ContiTech uses “cookies” to customize and improve Your use of the Service. Cookies are small pieces of information or data stored on Your computer or mobile device that are used to determine Your preferences and track certain behavior or activities when You use CrimpCloud. If You object to this practice, You may erase or block cookies.  We recommend, however, that You allow cookies to be stored on Your computer or mobile device as they may be needed to properly use CrimpCloud.  

 

You may also refuse the use of cookies by selecting the appropriate settings on Your browser, however please note that if You do this You may not be able to use the full functionality of CrimpCloud.

The Service uses Google Analytics, a web analysis service of Google LLC ("Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help analyze CrimpCloud performance and how users interact with and use the Service. We do not transfer your IP address to Google.

Security

We take reasonable precautions to protect Your personal information. For example, We encrypt certain communications using industry standards for encrypting such communications. However, We do not guarantee the security of Your information.  There is always a risk that information We collect or You provide may be compromised.  To mitigate this risk, You should (a) use secure usernames and passwords and carefully protect them from disclosure and (b) implement updated internet security and virus protection on Your computer.  If You suspect that Your computer’s security or Your information has been compromised, or Your password accessed or used by an unauthorized third party, please contact Us immediately to have Your password changed. 

A Note to Foreign Residents and Users Outside of the United States

The Service is hosted in the United States.  If You are a citizen of a country in or are accessing the Service from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please be advised that through Your continued use of the Service, which is governed by U.S. law, this Privacy Policy and the Terms, You are transferring Your personal information to the United States, and You consent to that transfer and our use of that information as provided in this Privacy Policy.

Third Party Websites

When You click on a link to any other website or location, You will leave our Service and go to another site and another entity may collect personal information from You. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of data after You click on links to such outside websites.  If You decide to access any third party links appearing in CrimpCloud, You do so at Your own risk.

Business Transfer

In the event of a bankruptcy or a sale, merger or acquisition, We may transfer Your personal information to a separate entity.  That entity will be responsible for ensuring that Your personal information is used only for authorized purposes and persons in a manner consistent with this Privacy Policy and applicable law.

Acceptance of Privacy Policy

By registering for, accessing, or using the Service, or otherwise providing Your Personal Information to We, You signify Your acceptance of our Privacy Policy. If You do not agree to this Privacy Policy, please discontinue Your use of the Service.

Pursuant to the California Consumer Privacy Act of 2018 (the CCPA), in the table below we provide a summary of the Personal Information we collected and disclosed in the prior 12 months. We have not “sold” Personal Information for money in the past 12 months, but we engage in routine business practices involving third parties that could be considered a “sale” or “sharing” as defined under California law. Retention. We retain your Personal Information as long as necessary to fulfill the purposes outlined in this Notice unless we are required to do otherwise by applicable law. This includes retaining your Personal Information to provide you with the products or services you have requested and interact with you; maintain our business relationship with you; improve our business over time; ensure the ongoing legality, safety and security of our services and relationships; or otherwise in accordance with our internal retention procedures. Once you have terminated your relationship with us, we may retain your Personal Information in our systems and records in order to ensure adequate fulfillment of surviving provisions in terminated contracts or for other legitimate business purposes, such as to enable easier future user onboarding, demonstrate our business practices and contractual obligations, or provide you with information about our products and services in case of interest. 

Your Rights

California residents have certain rights, subject to legal limitations, regarding the collection, use, and sharing of Personal Information. California residents may exercise the following rights via emailing us at privacy@continental.com, or by calling (833) 656-0555.

We will not discriminate against you, in any manner prohibited by applicable law, for exercising these rights.

Verification: In order to exercise your rights, we will need to obtain information to locate you in our records or verify your identity depending on the nature of the request. In most cases, we will collect some or all of the following data elements: first and last name, email address, and telephone number. In some cases, we may request different or additional information, including a signed declaration that you are who you say you are. We will inform you if we need such information.

Authorized Agents: Authorized agents may exercise rights on behalf of consumers by emailing us at privacy@continental.com, or by calling (833) 656-0555 and indicating that they are submitting the request as an agent. We may require the agent to demonstrate authority to act on behalf of the consumer by providing signed permission from the consumer. We may also require the consumer to verify their own identity directly with us or to directly confirm with us that they provided the authorized agent permission to submit the request.

Timing: We will respond to Right to Delete, Right to Correct, and Right to Know requests within 45 days unless we need more time, in which case we will notify you and may take up to 90 days total to respond to your request.
